By purchasing products from Tenebres Clothing (“we”, “us”, “our”), you (“you”, “the customer”) agree to the following Terms & Conditions. Please read them carefully before placing an order.

2. Orders & Contract Formation

• By submitting an order and completing payment, you are making an offer to purchase the selected goods.

• A legally binding contract is formed upon payment, and our offer is deemed accepted with due consideration at the point of purchase.

• All orders are subject to stock availability. If an item is out of stock, we will contact you to offer an alternative, delay, or refund.

• We reserve the right to refuse or cancel any order, including where payment cannot be authorised, an item is mispriced, or we suspect fraudulent activity.

3. Prices & Payment

• Prices are listed in GBP (£) and include UK VAT where applicable.

• Delivery charges are shown separately at checkout.

• We take all reasonable care to ensure prices and descriptions are accurate, but errors may occur. In such cases, we are not obliged to fulfil an order at the incorrect price.

• Payment must be made in full before goods are dispatched.

• We accept all major debit and credit cards, as well as Google Pay and Apple Pay.

4. Delivery & Pre-Orders

• We currently deliver to addresses within the United Kingdom and Ireland only.

• Delivery times provided are estimates only. We are not liable for delays caused by factors outside our reasonable control.

• Goods will be delivered to the address provided at checkout. It is your responsibility to ensure these details are correct.

• Risk in the goods passes to you upon delivery. Ownership passes to you once full payment has been received.

Pre-Orders

• Pre-order items are subject to variable shipping and production times.

• We cannot guarantee specific delivery dates for pre-orders.

• We will keep you updated on the status of your pre-order and notify you of any significant changes to expected delivery.

• If you wish to cancel a pre-order before dispatch, you may do so in accordance with your statutory rights under the Consumer Contracts Regulations 2013.

5. Returns & Refunds

• Our Returns Policy forms part of these Terms.

• You have a statutory 14-day cooling-off period for most online purchases under the Consumer Contracts Regulations 2013.

• Goods must be returned in unused condition, with original packaging and tags.

• Refunds (where applicable) will be processed within 5 working days of us accepting the return. Refunds are made using the same payment method as the original purchase.

• If you order the wrong size, you may return it within 14 days for a refund or exchange, provided it is in resalable condition.

• Faulty or misdescribed items are covered by the Consumer Rights Act 2015 and may be eligible for a repair, replacement, or refund.

• Items that cannot be returned (unless faulty) include: personalised products, underwear, swimwear, or goods with broken hygiene seals.

6. Customer Obligations

By placing an order, you confirm that:

• You are legally capable of entering into a binding contract.

• You are at least 18 years old.

• The information you provide (delivery address, payment details, etc.) is accurate and complete.

• You will comply with all applicable laws when using our website and purchasing our products.

7. Intellectual Property

• All designs, images, text, logos, product photography, and other content on our website are owned by or licensed to Tenebres Clothing.

• You may not copy, reproduce, distribute, or use our intellectual property without our prior written consent.

8. Limitation of Liability

• We are not responsible for indirect or consequential losses, including but not limited to: loss of profits, loss of goodwill, loss of opportunity, or business interruption.

• Our liability for any claim in connection with your purchase will not exceed the total price of the goods purchased.

• Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence,

  • Fraud or fraudulent misrepresentation,

  • Breach of your statutory rights under consumer law, or

  • Any matter where liability cannot be excluded under English law.

9. Force Majeure

• We are not liable for failure to perform, or for delays in performance, caused by events outside our reasonable control.

• Such events may include (but are not limited to): strikes, natural disasters, extreme weather, acts of terrorism, pandemics, supply chain failures, or transportation disruptions.

10. Privacy & Data Protection

• We will handle your personal data in accordance with UK data protection law, including the UK GDPR.

• Your details will only be used to process and fulfil your order, unless you provide consent for marketing communications.

11. Governing Law & Jurisdiction

• These Terms, and any dispute arising from them, shall be governed by and construed in accordance with the laws of England and Wales.

• You agree to the exclusive jurisdiction of the courts of England and Wales.

• If arbitration or alternative dispute resolution is used, it will be conducted under English law, in the English language.

12. Changes to These Terms

• We may update or amend these Terms & Conditions at any time.

• Any changes will not affect orders already placed before the revised Terms take effect.
